§ 1  Scope

1.1  These General Terms and Conditions (GTC) regulate the business relationship between Schrader GmbH (hereinafter “Schrader”) and its customers. They apply to all orders placed via the online shop www.stahlwerk-schweiz.shop.

1.2  Differing conditions from the customer are only valid if they have been confirmed in writing by Schrader GmbH.

§ 2  Conclusion of contract

2.1  All offers in the online shop are subject to change and non-binding.

2.2  An order is only concluded with the order confirmation via email, provided the ordered goods are available. Schrader GmbH reserves the right to reject orders without giving reasons.

§ 3  Prices

3.1  All prices are stated in Swiss francs (CHF) and include Swiss VAT.

3.2  Price changes can be made by Schrader GmbH at any time and without prior notice. The price at the time of order confirmation is decisive.

§ 4  Payment and late payment

4.1  Payment is made in advance. The invoice amount must be transferred to the Schrader GmbH account within 10 days of order confirmation. During this period the item remains reserved for the customer.

4.2  For business customers based in Switzerland or Liechtenstein, an alternative option is to purchase on account with a partial payment option via POWERPAY.

4.3  If payment is not received on time, the customer will be in default without further notice. From the time of default, interest will be charged on the outstanding amount at a rate of 5% per year.

4.4  After the payment deadline has expired, Schrader GmbH reserves the right to either withdraw from the contract and put the item up for sale again or to insist on fulfillment of the contract and enforce payment in court. All costs of operation, debt collection measures and any legal fees are borne entirely by the customer.

§ 5  Shipping and delivery

5.1  Shipping within Switzerland is free. Deliveries abroad are possible on request and will be agreed separately.

5.2  Delivery times are guidelines and not binding. In exceptional circumstances (force majeure, delivery bottlenecks, etc.), confirmed orders can be canceled by Schrader GmbH free of charge.

5.3  It is possible to have the goods picked up in Ermatingen upon request.

§ 6  Transport damage

6.1  Transport damage is automatically insured up to an amount of CHF 500.

6.2  Damage must be documented with photos and reported to Schrader GmbH in writing within 4 calendar days of receipt of the shipment. After this period has expired, transport damage can no longer be claimed.

§ 7  Warranty

7.1  The warranty period is 2 years from the delivery date.

7.2  Excluded from the warranty are damages caused by improper use, lack of maintenance or normal wear and tear.

7.3  In the event of a warranty claim, Schrader GmbH decides at its own discretion whether to repair or exchange the item. A refund of the purchase price is excluded in the event of a warranty.

§ 8  Returns, Exchanges and Cancellations

8.1  Private customers have the right to return items within 14 days of receipt without giving reasons, provided the return has been reported to Schrader GmbH in writing in advance.

8.2  The return period is 14 calendar days and begins with receipt of the order. The goods must be received by Schrader GmbH by the 14th calendar day after receipt. An extension is not possible.

8.3  The goods must be returned complete, unused and in the original, undamaged packaging. The buyer bears the direct return costs. The sender is liable for damage during return transport.

8.4  If returned in perfect condition - unused, complete and in its original packaging - the purchase price will be fully refunded. If the returned goods show signs of use or wear of any kind that go beyond the handling necessary to check the quality, Schrader GmbH reserves the right to deduct an appropriate reduction in value from the refund amount. The amount of the reduction in value depends on the determined loss in value of the goods.

8.5  The refund will be made using the same payment method as the original payment, at the latest within 14 days of receipt and inspection of the returned goods.

8.6  There is no right of return for business customers (B2B).

8.7  There is no right of return for goods that were manufactured or configured according to individual customer specifications.

§ 9  Limitation of Liability

9.1  The liability of Schrader GmbH is limited to direct damages. Any liability for consequential damages, lost profits or indirect damages is excluded to the extent permitted by law.

§ 10  Data protection

10.1  Customer data is collected and processed exclusively for order processing. The data will be treated in accordance with the Swiss Data Protection Act (DSG) and will not be passed on to third parties without express consent.

§ 11  Changes to the Terms and Conditions

11.1  Schrader GmbH reserves the right to change these terms and conditions at any time. The version valid at the time of the order is authoritative and will be brought to the attention of the customer during the ordering process.

§ 12  Place of jurisdiction and applicable law

12.1  For all disputes arising from or in connection with these General Terms and Conditions, Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

12.2  The exclusive place of jurisdiction for disputes with business customers is Arbon, Canton Thurgau. The statutory place of jurisdiction applies to disputes with private customers.
